i live in south dakota and my kids and i moved out of our home over 2 years ago and left my husband behind. we own the home together and i have asked him for months to help me sell it because neither of us can afford the payments on our own. he refuses to help me get it ready to sell and he wont move out. i am living in a duplex above my parents owned by them rent-free, but i need to get out of here. can anyone suggest how i can get him out of that house so that we can get it sold. last month i refused to help pay the house payment, but up until then i have been helping with it. that has not even helped as far as i can tell.

You said you and the children moved out over 2 years ago. Have you taken any kind of action, such as filing for divorce? You need to get the law on your side. File for divorce, and either ask for the house or request that the house be sold and the proceeds split.

Whatever, until the house is yours alone, don't go to a lot of expense or work yourself to fix it up. He'll watch you spend your money and labor, then he'll share in the gain.
