Can you further define for me the meaning of a seperate property state.I am from Massachusetts.You had answered a question from me last week about division of assets.I guess i understand what your saying, but what about stock accounts and 401K, does this mean if they are in his name I am entitled to none of them. As far as the stock acct. we had some extra money, we each picked a stock, mine made a killing, his faultered. But because the acct. is in his name, I get none of this?And probably none of this matters, but Ill tell you anyway. For the first 5 years, we made the same amt of money. Actually I made a little more. Then he got a new job, and for the next 3 years, he spent about 60% of the time out of the country on business.Leaving me here to maintain the household the bills ect. The year after that, He had no license for almost 9 months...DUI..the next year his dad got sick, and for 6 months I took care of him...the next year he lost his license for almost 7 months ..DUI..again, did not get convicted...I guess what Im saying is yes..he worked, But thats about all he did. He couldnt even go to the store for gods sake because he had no license and I maintained everything..And after all this..if its in his name..I get nothing? Sorry if i took up your time. Im not looking for anything i dont deserve. I guess the law just doesnt seem fair to me..Thank you

My response:

Basically, in a separate property State, if it's not in your name, you don't get any part of it.

Next time, get married in a Community Property State (CP). Automatically, half of all debts and assets are yours. If MA was CP, you would have made a killing. Instead, you just get killed.

You're right. The rest of your post doesn't matter.
