My husband and I live in Tennessee. We have been separated since February (I moved in with family, he's in our house), he says he wants to live the independent, single life; which includes dating. Our finances and all has remained the same; joint accounts on all. Is there a legal agreement that we can have drafted up to protect both of us from filing adultery charges? I know about a legal seperation but this requires division of property, assests, debts, etc... We both benefit financially to stay married at this point. No kids involved, married for 12 years. Please advise.

Also, how is the division of marital property in the state of Tenneessee figured? We have alot of equity in the house that he lives in (both names on it), can the court either make him sell the house or buy me out.

Click on the following link for a source for Tennessee property settlement agreements:
http://secure.uslegalforms.com/cgi-bin/forms/query.pl?S-C-B-B-settlement~agreement~Tennessee
This site includes several different forms, including one for 'no children, with property'. When you find that form, you will see several optional hotlinks. By clicking on them, you can see a summary of the applicable Tennessee statutes, a sample of the form you could purchase and the ability to purchase either a download or hardcopy of the appropriate state format.

In reviewing the offered sample, it appears to be pretty inclusive.

Also, you might consider checking with your local library or large bookstore to see if they have a 'do-it-yourself' book on Divorce in Tennessee.
