Septic field encroachment follow up

I posted a question on May 28 and this is a follow up. Our neighbors' septic field is encroaching two feet into our property line (presently a vacant lot). We notified the county health dept(who approve septic fields in Fl)and they did not take us seriously until we had the property line re-surveyed at our expense on March 17. A couple of weeks later, the county told us (verbally)that we were right and that they would make the neighbors fix the encroachment; they would send them a certified letter giving a limited number of days to fix it since the field is not only encroaching, but it is also out of compliance (the slope has eroded badly) Here we are 3 months later and the county has not sent the neighbors a notice. Absolutely nothing has changed as far as the encroachment, or the eroding mound. My calls to the county are met with polite "we are working on it, we have been very busy", yet our patience is wearing thin. What are our options? I don't want to directly sue the neighbors, how do I get the county to do its job? Any suggestion about other agencies to call? Thanks for your response.

Start sending letters to the appropriate county agencies so you can maintain a paper trail. Send copies to the City Council members and the Mayor. When the County workers make verbal statements, follow up with a letter to them to document the statements made.
Ex: Dear (State name of indivdual you talked to) at County health agency, on June ______2000 we discussed a septic field encroachment situation concerning my property located at (address). At that time you stated that my survey was correct and that you would take action to inform the neighbors to correct the encroachment. This action was to be completed via the County sending a certified letter to the parties giving them ______days to rectify the problem. As it has been over _____weeks now, please provide me with an update as to what has been done to date. Please forward a copy of the letter you have sent out to the (neighbors name).

You may also send a similar letter to the neighbors stating that you talked to the County and are requesting that the neighbors comply by relocating the fields such that there will be no encroachments.
