Hello, My name is Rick Johnson. I have a problem in my hands. I would like to know if I have a case or not. Here is the situation.

One day my friend and I was going up the escalators at the local mall. While we were walking up the escalators, my friend tired to 'hug' me and while doing so, he swiped my platinum diamond earring off my ear. We tired looking for it but there was no luck. We couldn't find it anywhere. He said it was my fault because it was not secured all the way. But regardless of that, isn't he still at fault?

I am ready to take this to court because he does not want to pay me for the 'lost' earring. Please tell me if I have a case. And other comments anyone would like to add. Please respond.

Did he have your "IMPLIED CONSENT" or "EXPRESS CONSENT" to ever hug you prior to this incident; e.g., has he ever hugged you before, and you allowed it ?

Well, he knows I don't like to be hugged. He knows I DON'T LIKE HIM HUGGING ME. But still he continues to hug me.

I hope I can win, that earring was really expenise. PLEASE, PLEASE, PLEASE - help me out. Ask me anykinds of questions you may have. Thanks.

The way I see it, it was an ACCIDENT and you are equally respnsible for A. Not fastening your earring correctly. or B. Purchasing an 'expensive' earring that does not fasten safely to your ear. I think you should feel lucky that this friend helped you look for the earring at all.
