i own condo in florida. tried to serve defendant (another owner) at his residence in Illinois. Sheriff unable to serve. could not find defendant. in small claims court, volusia co., fla., judge dismissed for lack of service. Defendant's condo sprung a leak and damaged mine on first floor under his unit. how can i get service on this "lost" owner? the judge mentioned something about suing an "alias" i didnt understand that. apppreciate any assistance you can give me.

Owning a condo means you typically belong to the homeowners association. If they have one see about collecting the money for repairs from them. Being he is out of state does he rent this unit out through a local management company. if so they probably have a contract with the owner to procure repairs for emergencies. But more so than not this should be an issue for your homeowners association if you have one. Last search the local recorders office for proof of ownership. Send a certified return receipt letter with the service notice inside. Typically this is action enough for the Court. If not find out where he works your condo association should have this info. I hope this has given you some ideas.
