My husband just filed the paperwork for a divorce in California(he's military, stationed there). I live in Colorado. He had his Mom serve me with the paperwork. When someone serves you with a summons, isn't there something that you're supposed to sign for them so they can prove they served you? She just handed me the papers, said "these are for you, I suggest you read them" and walked off...how can she and my husband prove that I was served if I didn't sign anything? This really has me confused, any help anyone can give me would be greatly appreciated!

My response:

No, you don't need to sign for anything.

All "Mom" has to do is fill out, and sign, a "Proof of Service", which she signs under penalty of perjury, that she did, in fact, serve you with the papers.

Then, she sends the P.O.S. to your husband in California, and then he files the same with the court.

It's a done deal.

Better get an attorney. You've only got 30 days to respond. If you don't, he'll take your "Default" and you'll lose automatically.

Thanks for such a quick response. unfortunately, I can't afford an attorney, as I am currently unable to work due to a complicated pregnancy, and have no money at all, since he's not been providing any kind of support. Also, there's no way I can make it to California to represent myself, as I will most likely be in the hospital having a baby when the thirty days are up(yes, he timed it that way on purpose) Any ideas on what I could do?
