i live in illinois. my husband and i have been seperated since sept., 2000. i filed papers for divorce in january, 2001. if i signed a settlement agreement prior to filing the papers, am i legally bound to honor that agreement?

My response:

No. It never had any force or validity under the law. The only time a settlement agreement has any validity is when one is submitted to a judge for approval and signature. Anything else isn't worth the paper it's written on.
