What is the name of your state (only U.S. law)? MN
I was told my former employer would possibly like to settle a disability discrimination complaint for wrongful termination. Charges are in the process of being investigated through the EEOC. I was told to come up with a settlement amount. How does one determine a settlement amount that is not too low nor way out of range? The actual Loss of wages and bonuses equal about $1700. I don't have a lawyer yet. I was told, by a lawyer, that hiring a lawyer could wait until it goes to an actual lawsuit, since the EEOC will do the investigation and turn over all materials gathered. Was this good advice?

Sounds like they just want it to go away. For this small of an amount it's not worth their time and they would pay more in attorney fees to defend. I would offer double the amount of lost wages.

The company has offered a settlement. They list these terms (among others):

3) Compliance with the ADEA requirements to achieve release of those claims, through the date of signature, given that he is over 40;

4) If he claims any connection to Minnesota, work or otherwise, such as residency, then compliance with the 15 day waiver requirement on release of MHRA claims as well;


What does that mean?? The discrimination was not based on Age. It was based on a disability.
