Maryland. I used a mortgage broker to get my mortgage. I was scheduled to go to settlement on 6/8/01 at 1:00pm, in my lawyer's office. I received a call at 11:15 from my lawyer stating settlement was postponed because the papers had not been received from the mortgage broker. The mortgage broker said they were 'backed up'.
Realize that I had taken a day off from work and driven two hours to the condo that I was supposed to purchase. I had also scheduled electric, cable,and telephone service to begin that day. At 3:00 that afternoon, the mortgage service was still asking me questions regarding my savings accounts.
Is there a form of recourse that I can take either with the lawyer for being negligent in his responsibility to make sure everything was in order prior to settlement day or with the mortgage service for not fulfilling their obligation for settlement on the specific day?
The mortgage service informs me that once I send them copies of banking receipts, I can settle on the 6/12/01. I originally sent them all information that was requested over one month ago.

The mortgage broker is at fault. If they were backed up they shoud have taken ExLax, Metamucill or something. Get the requested docs to them ans close. After closing, you can file a complaint against them with the State.
