Nevada; Living in her father's house now 9 years, she's gone but he's promised the house to her. Can I include it in the settlement? We never paid rent, I just assumed it was part of the marriage package. I just signed a continued 6 month lease and she lives with her new boyfriend, but she plans to move back in here, with him, after my lease is up. Any way I can stop that?

You have no claim to her father's house, although he'll have to evict you formally if he wants you to leave.

Unless you file for divorce and request exclusive use of the marital home - which I believe you were told in September - she is free to come and go (even with her boyfriend) as she pleases.

You really - again as you were advised earlier - need to be looking for somewhere else to live, since it seems inevitable that you'll be evicted at some point.

Consider all that no-rent you paid all those 9 years as extra money in your pocket.

Is there a legal seperation? When did you enter into your lease agreement with your landlord?

If the house belongs to her father, and he has promised it to her, then there is nothing you can do and it is NOT a marital asset. Gifts or inheritances are separate property.

Right now the house is not even a gift or an inheritance. A zillions things could happen during dad's lifetime that cause it to never be owned by STBX. Right now STBX has no ownership or option rights to dad's property at all.

Lease started 11/02. Yes, there is a legal separation.

Nothing divided in the divorce, I ended up donating most of her belongings, the kids stayed with me. The owner - her father - rewrote me a new lease to stay in the home. The kids and I eventually rented a home closer to their school and her father sold the house. For the record, too much worrying about nothing.
