Hi. I would like to know if it is standard policy for the attorney to receive 30% of the settlement. I know that they get a percentage of the personal injury settlement, but do they also get a share (30%) of the property damage settlement or should the client get full amount?

My response:

Well, that depends.

1. Is there a clause in your retainer agreement that says attorney gets XX % from any recovery?

2. Whose insurance paid? Yours, or the other person's?

3. Who did the work to obtain the recovery, you or the attorney?

anywhere from 25% to 40% of a totla recovery is not uncommon; please read carefully the contract and talk to your lawyer about it.

My lawyer is deducting 33 1/3 from my settlement - and will also be deducting expenses for phone calls, making copies, faxes, postage, etc.

So you may wish to discuss the incidentals with your lawyer as well....
