This is from the State of Texas, Brazoria county.

My husband and his siblings have been trying to settle their father's estate in which there was a will. The problem is that their father married a lady, a few years after their mother died, that was part of the Phillipino underground scam on elderly men to steal their estates. The will is decisive. This wife had torn up the will, but fortunately the kids had found a copy of the will and needless to say she was FURIOUS. Otherwise she would have taken everything from them. It has been tied up with lawyers for almost 3 years and nothing is being settled because they were told she has the right to stay in the house as long as she wants. But as far as the personal property of their father and their mother, she has kept them from this. She has even sold a vehicle that was not hers to sell. She tried to take the money from a life insurance policy that was set up to pay for the funeral. Luckily it was known about and the funeral was paid. Before his death in the last few months when he was so ill, she tried to re-do his will for him, but no-one would sign it. This has been dragging on and the kids are really just wanting to get this settled once and for all.

It has been publicized on television about this Phillipino underground. They were unable to get there dad declared incompetent because he knew his name, the date and once in a while his age. But he was not competent to be handling everything. The kids ended up doing everything as he spent many months in the hospital.

They are upset because there has been no action and this is due to her and her lawyer. She keeps stalling on a settlement. The last contact was she said it would probably be another year before she was ready to think about settling anything, due to something about having to talk the people in California. What this has to do with anything is beyond anyone! The kids would like some of their parents' possessions. After the funeral she set up an appointment for them to come get things, then the day this was to occur she through a fit and accused them of stealing from her. She only wants the stuff to sell for money.

It is such a crime that this goes on in the US and the courts know about it, but nothing is done to stop the prey of these women on these elderly men. And end the end, it is the families who get hurt while this woman who was only in the picture for a short time comes in and takes everything from them.

With a will, shouldn't they be able to settle this. Even if she does have the right to stay in the house, shouldn't they be able to get the personal possessions and the possessions they were to inherit?
Shouldn't she be paying the property taxes, now that it is "her" house????

We need to know who to turn to what to do, as the estate is not real big and money is limited, but justice needs to be served here, and soon! We are growing weary and feel cheated by the woman and the judicial system.

How were his assets titled/beneficiary desig's and was a probate estate opened?
