i was divorced in ny state.i was not properly represented by my attorney, my husband pretty much got all the property he wanted, he did not pay for any debt incurred,i will not receive his pension or anything related to retirement account.our home which is in my ex's name only was my family's home prior to us buying it in 10/96.majority of debt went into my name therefore making me unable to add my name to mortgage or title.divorce was finalized 6/00 he remarried 7/00. since he left in 7/98 i have paid the mortgage, house ins.,taxes and all related upkeep and repairs.I have done quite a bit beyond just upkeep.he contributes nothing.per divorce decree i am to claim the house on taxes he of course is ignoring this.per decree i am to pay him $5000.00 and secure a mortgage in my name by this month or vacate and sell the house.i was at least smart enough to get it stipulated that i buy the house for current mortgage balance instead of market value.i have been pre-approved at one place with a second contingent pre-approval, but these are at high interest rates.he will not provide me with a buy out letter.any ideas on turning this around?is there a way for me not to pay him $5000.00.his delay will put me in violation.how do i hold on to my home? he is now going to try and get me thrown out.the ideal situation would be if he would hold the mortgage for another year or even 6 months and refinance at a lower rate.
