My husband, 6 yr. old stepdaughter, & I were involved in a car accident several months ago. We are getting ready to settle w/the insurance company. I know that we will get a separate check for each of us. Will my stepdaughter's check come in her name or mine & my husband's because she is a minor. If it does come in her name, does it have to be deposited into an account in her name. Can we just cash the check to buy her school clothes, etc.?

This may vary with each state, but many states require all settlements that involve minors to be approved by a court. This is intended to make sure the minor's interests are protected. Please see an experienced injury attorney before you settle; most will do an initial consult for free. The adjuster generally owes you no duty to settle for a reasonable fee; his/her job is to get rid of the claim as cheaply as possible-regardless of what you are entitled to and once a person settles, they generally cannot reopen the settlement later if they find out it not reasonable.
