severe eye problem

2 wks ago I went to a major eye glass company to get new glasses.I had the standard eye exam and the dr.then dilated my eyes for a further exam.A few hours later at home I began having headaches and feeling nausia.my husband called the dr back and related whats happening and he said that im farsighted and sometimes you get headaches from dialation.
As the day went on the headaches and nausia grew more intense,with frequent vomiting.My husband called the dr back and reported this and he said he never heard of this before and he will adjust the doseage of drops for the next dilation and he hopes my wife feels better soon.That night i vomited every hour or so and my head pain became unbearable.In the AM my husband called 911 and i was taken to the hospital.The emerg. dr stopped the nausia and gave me morphine for my headache but never did take it away fully.My husband asked the dr about my eyes and that they were dilated the day before and he said her eyes looked ok,but at this point i could not see at all only fog.I was sent home basicly in the same condition that i arrived except my nausia was gone.The next morning my husband called the eye dr back and related what has happened,he asked me to come in and see him.By this time i was so weak i could hardly walk but managed to hobble in with the help of my husband and daughter.He looked at my eyes and said i have an infection of both pupils and i should go to the emerg.rm emead.
We went to the hos. and waited 5 hrs to see a dr,when he looked at my eyes he called a ophthalmoligist right away and reported what he found.The ophthalmoligist opened his office at one AM to see me.After he examined my eyes he told me i had a severe case of acute angle glaucoma brought on by the dilation of my eyes and i will have perminant
damage to my eyes.The pressure in my eyes was 4 times higher than normal.He worked on me for 4 hrs pushing on my eyeballs to squeeze out the liquid that built up.The next day i
had to see another specialist to have laser
surgery to relieve the problem.I was told if
the eyeglass dr acted when he heard the problem my damage would not of been so severe.
Both my pupils are deformed(football shape)
and my vision still is not normal.My question is do i have a case against the eyeglass company. VS California

You have a case against both the doctor and the eyeglass company, if the doctor was working for the eyeglass company or was referred by the eyeglass company.

This is medical malpractice to say the least. You will need a medical malpractice attorney. Make sure your attorney subpoenas all of your emergency room visits, the specialists visits, etc. to document exactly how damaged your eyes are.

You see medical malpractice boils down to three basic elements (although a lot more complicated than this) -->

1. you weren't contributorily negligent, if anything you responded very quickly to try to get the problem resolved.

2. this type of injury would only happen out of negligence.

3. doctor was negligent/eyeglass company.

if this type of injury would only happen due to negligence by doctor, then you have a pretty good case.
