We just bought a house this summer. All the paperwork (the listing, appraisal, and seller's disclosure) indicate that the house was hooked to public sewer. Well, we have since discovered that the house has a septice tank, which has backed up into the house. The sellers now say they didn't know it was not on sewer although they lived here for over 15 years.

What would our recourse be short of going to court. If we have to go to court, what statutes can we site in doing so.

My response: hire an attorney to negotiate some sort of settlement. If court action is needed the attorney would research the applicable statutes in the State that applies.
