alright if anyone would help me out that would be great. A girlfriend saved "sexting" messages they were NOT PICTURES merely text messages sent. After a fight we got in she threatened to press charges on me for this even though they were asked for. I am 18 and she is 17 not even a full year apart. I kept the messages with the threats. She has not pressed charges but I am wondering of legal actions that could be taken and any defense so please help me out here. I am not a bad kid college student with a 4.0 just was not thinking straight at the time PLEASE HELP.

Where did you get the idea that it had to be pictures before any legal action could be taken?

The age of consent in ND is 18. She is still a minor. It is illegal for you to be making any kind of sexual suggestions to her. So yes, legal action can be taken, and I'm not seeing any close in age exceptions in your state. So you can't use the fact that she's less than a year younger as a defense. She is a minor. You broke the law.

What does your grade point average have to do with anything? I don't get these kids who seem to think their GPA is a defense for breaking the law. It's not.
