My x husband sued me for custody of 12 and 14 yr girls, last week during mediation he said there was improper sexual behavior by current husb. I found out that current husb. tried to rape my then 11 yr old daughter 3 years ago. I immediatly filed for divorce, a order of protection and had him immediatly evicted from our home, filed for custody, he has no contact with our two kids 3 and 5 but my x lives in FL and I live in OH and I called my x to tellhim about it and first of all he says he will make current pay...and that he still wants them to live in FL even though current is no longer in home and there is a order of protection.

He thinks the order of protection will cause him to go wacko and he will try to do something to them. I don't blame him for fears, but the girls are going to FL for the whole summer and will be away from the situation for 8 to 10 weeks.

Do you think the judge will still send the girls down to FL now that the abuse has ended.

By the way, I had no idea until yesterday 5-24-01 that this even happened 3 years ago and left him immediatly. Isn't that considered doing whats best for the kids and protecting them. I think he's mad that I didn't protect them earlier but I couldn't protect them from something that I didn't know was happening.
