To make is somewhat short, my son has been accused of sexual assault of my brother in laws 3 year old. My son is 14 yrs old and has been charged with these accusations. He as went to the preliminary court hearing and the judge put him on house arrest, counseling, blood tested for sexual transmitted diseases, and has gone through a psychosexual test. He scored the lowest on this test.
The intentions for my son going over was for him to do some yard work, such as cutting the grass, weed eating, and such to make some extra money. This was this past summer when this happened. Is there any negligence on the father or parents that invited my son over to do some yard work, since there was no supervision of these minor children? There was also another minor girl there that was the daughter of the mother that was also there at the time. The mother was sleeping since she works 3rd shift. The father was either sleeping or left the house to do some errands my son said when this happened. If you have 3 minor children in the house and one of them is 3 years old, when is there negligence of supervision of a parent? There are also, many other things that are going on with this family, such as the father just got out of a alcohol treatment center because he was going to lose his job if he didn’t follow through with the program because he was taking anxiety medication and drinking. I know that he has also put his child in danger while drinking and driving. They also don’t want to pay for daycare so they took their unruly 15-year-old daughter out of high school to watch there 3 year old. This daughter is sleeping with 19 years old and has been kicked out of school various times and also has been kicked out of alternative school. She has been in juvenile and psych. Hospitals. Is this the type of girl you want watching your 3 year old?
We are going to court in February to find out what they are going to do with my son, and the family is trying to do all they can to put him away until he is 18 years old. This father thinks this is a game and it is a mess within the families. Do we have a right to file negligent charges on this family since he wants to play the game and just let the court do what they are going to do? Also, what other case law is there out there on negligence and sexual assault of a younger child that I can look up?

While all of that is distressing, it still doesn't erase what your son did. Does your son have an attorney yet? If not, ask for a guardian ad Litem to represent his best needs, they can also make what ever referas are needed, such as to protect the other children, perhaps a GAL for them as well and or possibly a report to CPS or a homestudy, It is better for a mandated reporter to call CPS rather than an interested party. Your son needs help in many ways, it is not entirely the fault of others.
