Sexual harassment

What is the name of your state? CA

My 10 yr old son who is in the 4th grade, in special education, functioning on a 4/5 yr old level was suspended for sexual harassment. He told a teacher "I see your booby line"... he then apologized after the teacher told him it wasn't a nice comment. this incident happened on a monday and we didn't get a call until the following monday. I don't think the comment he made is consider sexual harassment... he's just stating the facts. We tried to talk to the principal to take suspension record out of his file.. no progressive discipline, no review of his file to see that he had developmentally delay of a 4/5 year old and that maybe the comment he made was just a fact... Teacher also have dress codes right? My other daughter witness it and stated that she also saw a small line on the teacher chest. What else can we do? I believe the suspension action was inappropriate. Any advice would much appreciated.

What does his IEP say about behavior? Does he have a BIP or is he able to understand and follow school rules? Sounds like rather harsh punishment. Did the ARD Committee have a manifestation or discipline ARD? You need to request an ARD meeting, include the pyschologist plus all the other usual members. I've worked with principals that had no real idea of how powerful IDEA is or how it works.

what I want is to remove that sexual harassment comment from his record and point out that the principal should know the regulations or law before leveling it a sexual harassment... what happened to progressive discipline and how about not waiting a week later to punish a disable child.

what is a BIP? ARD? How powerful is IDEA and how it works?

My son has behavior problem mainly because he's not a his age level and being teased a lot, he sometimes have short term memory and so far we have no issue of him following school rules. I didn't know that we have to put everything in his IEP about behavior and how to discipline... I thought IEP was just for goals.

My husband was able to comfront the principal and stated that she had violated several codes and the comment made by my son was not the diffination of sexual harassment. He demanded all records in regards to the sexual harassment charges be given to him for distroy. The principal commented that she's new to this and that she needs to review everything.

Thanks for all your advice... this is a learning process for us. We want to protect our son who will always have issues in life because of his disability. We will try our best to educate him.

recovene the iep and go over the present level his understanding at this level. request for a functional behavioral assessment and bip. if he has a bip you need to adjust it for these type of issues.

sounds like you need to contact an advocate and get help with your iep. your son needs his current level of understanding in his iep. he needs an bip also. you can get the advocate to help you on the suspension as it is a manifestation of his disability. you should also consider goals in this area to teach him what is appropriate to say. he needs to learn this now in addition to his education. sounds like he needs social skills and goals in this area.
