I was the seller. I closed on a condo this afternoon. I made an agreement with my agent to pay for 6 months of HOA fees and some extra money to the buyer. The total was over $2k. The strange part was that nothing was in writing and I was told to give the seller my personal check at the closing, but not to let anyone see. The check was made out to the condo association.
1) Is this legal?
2) I owe past HOA fees, since I have nothing in writing on where the check goes to, can I call the association and tell them the check I wrote is for my past due HOA's? I know this is wrong, but the whole transaction I've been taken advantage of because of the rough market here. (from agent fees, supplying a new A/C, my partner not paying his portion leaving it to me and now the HOA's).
Since it's closed now, I would like to 'get back' at these guys. Again, I know its wrong. What would you do?
