Alright, basically what my situation is...
I bought a "Classic" car from a dealership about 6 months ago.
I paid cash for it and I haven't gotten a title yet. When I first bought it the people assured me that the title would be in the mail in a week.
Well, weeks have turned into months and everytime I call up there, they give me the run around about it. She says that it's in the mail, yet she says she is getting a judge to write one up? Then I called up there to see if I could just get a refund and she said she doesn't have the money to refund me?
I called the DMV and they said they can't get a clear title for the car.
It had been voided?
I have two temporary plates for the car that have expired, I can't drive it because of that fact. Then I have NO proof that the car is actually mine [EXCEPT the Bill of Sale].
Am I entitled to a refund or can they actually get away with all of this?
 


You do have recourse

First of all I am not a lawyer nor anywhere near it but I am a licensed Motor Vehicle Dealer though not in your state. However, somethings apply across the board when purchases are made from a licensed dealer regardless of state. (I probably shouldn't say that, Louisiana is a bit different in some respect with it's old French based laws) so I may be way off base on what I am going to tell you.
First, a vehicle sale is not complete until a valid title is delivered. In most states, 30 days is generally allowed for this. All states have a division that regulates Used Motor Vehicle Dealers. It may be the Tax Commission or the Used Motor Vehicle and Parts Commission. The divisions have investigators to "investigate" and resolve issues such as yours. Contact your DMV to find out exactly what department in your state is responsible for regulating and licenseing Used Dealers and contact them. Dealers are bonded. When something like this occurs and they are found to be a fault, if they cannot make good money wise, a claim can be made against their bonding company. Normally the bonding company refunds to the claiment and then goes after the dealer to collect from them. There is also the matter of their license. Different states, different laws but licenses do get revoked and sometimes the mere mention of it is enough to get the job done. BTW, what exactly did you buy?

And what was the sellers response when you WROTE them a letter (certified RRR) detailing the problem and POLITELY making a demand for either a valid title or a refund (less costs for usage) within 10 business days??

Also, Louisiana requires auto dealerships to be licensed by the 'Louisiana Motor Vehicles Commission'. You might contact the licensing agency and see about filing a complaint as to their conduct:

Well, to answer your first question, I bought a 1972 SS Chevelle.

Secondly, I contacted them on several occasions and I was VERY polite to them even though they were quite rude to me to begin with.
I've gotten a D.A. from my city to contact them and ask them for the title and they won't take the calls anymore. You'd think if they could get a "valid" title written up by one of her "connections" they would of done so already.

I know I've got burnt basically, but I want to know if there is anything I can do about it.
 
Start writing................

You've been given places to start for remedies. La. Division of Motor Vehicles for one. Put it in writing and get started. Dealers are bonded. If your claim is legitimate, file a claim against their bond. You can get the name of the Bonding Company from DMV licensing division.

I did post to other sites to get opinions, but who wouldn't, seeing how much money I put into the car. It's only natural to try and get all the information I can.
As we speak, a judge is going to be deciding if he's going to write a new title or just refund me. I really thought once you had a title and it's been voided, you can't do anything about it, but hey, I'm no lawyer.

Classic cars can be difficult.Lot's of times these cars are stored in garages, shops or even sitting in back yards without the owners keeping the tags updated. In some states when there has not been any action (transfer, tagging, etc) on a vehicle over a period of so many years, the titles are purged from state files. Most of the time the files can be reconstructed with proper documentation. Ocassionally, you run into things like damaged computer files when the state can only go back so far, then your at a dead end on that approach. Good luck and congrats on your purchase, I hope you enjoy it for many years to come.

I was so excited when I first bought and I drove it everyday, but as of lately since the plates are expired, all I can do is look at it. Which isn't that bad because its a beauty, I would just rather drive it, you know what I mean?
I'm hoping everything is going to turn out well.

What is the name of the dealer ? I am a retired investigator with the La. Recreational and Used Motor Vehicle Commission. Have you notified the agency ? The dealer can be brought in for a hearing for not delivering you a title wihin 20 days. The dealer also has to pay any late fees and penalties. Send me the dealers name .
