my mother bought a house and then gave it to me and my brother, only my name and his name is on the deed. my mother and brother continued to live in the house for several years. the gas and water got shut off and they semi moved out...so i told them that if they were out form more than 30 days i was going to clean it up and fix it and me and my husband and 2 children were going to move in. we had to replace busted water lines, fix the roof, paint, put up new dry wall from where dogs ate through it to get out, we took out at least 40 contractor bags of trash, and i alone have been paying the taxes on the house for the past 4 yrs with no help from him. now him and my mother want the house, and they want to kick my husband out, i already know by west virginia state law they cant. but is there any way i can take complete ownership of the house without buying out his half?

short answer: no

In fact, brother has every right to move back in and he can allow mom to move in as well. Unless there is a unequal division of interest between the owners, each has equal right of possession and control.


You would have an action against brother for his share of the taxes. I presume you paid half of the taxes when brother and mother lived in the home. If not, you would owe brother your share of taxes for that time.
