Sharing Cost of Fence Repair

What is the name of your state? California

For the past 3 years we have been making repairs to our fence without the financial support of our neighbor (directly behind us) who equally shares our fence. We have shared emails with him and he states he doesn't have the money to put into a fence right now. He is an investor. I suggested that it is his turn to handle the repairs which would be significantly cheaper than a new fence (which is really needed).

His tenant's dog regularly comes into our yard and ours goes into his. I am now putting my dog on a chain as I don't want her leaving our property. This situation doesn't seem to bother him, either.

He used to respond...now he is not even responding either way.

If I put more money into the fence, will I get a judgement in my favor if I take it to small claims court?

General Court Responses???

I was just wondering if California courts typically rule that both parties share in the expenses incurred to maintain a common section of fencing.

We both have dogs and theirs visits us through the holes in the fence. We are now having to tie our own dog up to maintain responsibility for her.

This seems obvious but I merely want a general idea of whether judges rule in "sharing" the costs in most cases.

Is there a way to locate records in my county or town regarding similar suits to see what the rulings have been???
