My husband and his ex-wife have verbally agreed to alternate who is claiming their son on income tax returns. The original divorce agreement gives her the deduction. Can the court be petitioned to change this, or does a lawyer need to be involved?

It depends on if he trusts the ex wife.. if he does, then all he needs from her is a tax form (I can not remember which) which would grant him the right to claim the child that particular year. Without a court order she can change her mind anytime.

You can ask the court to change this, But I think (someone correct me if I'm wrong) all they would have to do is the IRS form 8332. You should contact the IRS to make sure, they might want a different form depending on the year and wording of the divorce.
