ok me and my girlfriend were sexualy active when she was 15 and i was 17. then i hit 18 years of age had sex. now her parents want to press charges. now out of what i have been reading i am somewhat safe. one thing i read was something called the 4 year law which means because she is 15 she can not be active with anyone over 4 years of age. also i was also told that due to i had permission to date her from her mom that i m also safe. i just want to know how worried i should be. thank you

Worried about the police? Unless you have a lawyer on retainer, probably always a good idea to worry about the police. However, who you REALLY need to fear is her parents. Probably don't want to meet her dad in a dark alley anytime soon.

Be worried enough to abide by her parent's wishes. Out of respect if nothing else. My husband would have the shotgun ready and waiting if you went against our wishes.:D

belive me i have already got the threats from the parents. her mom does not want to press charges on me, it is her dad. but besides that, is what i have been reading true?
 
It is true that if the age difference is less than 4 years and the sex was consensual, it is not a felony sexual assault.

HOWEVER the age of sexual consent in New Jersey is still 16. Having sex with her may not be a felony but it doesn't mean it's legal, and there may be other lesser charges besides felony sexual assault that could land you in big trouble if the dad goes to the police. I'm not a lawyer and I'm sorry I don't know more specifics but maybe some senior members know more about those.

Either way you need to stop touching underage children.

If you are looking for a law you can wave under her dad's nose that grants you the right to have sex with her, you can stop looking. There isn't one. In fact, there isn't even a law you can wave under her dad's nose that will require him to let you SEE her.

If dad says no, it's no. If dad says no and mom says yes, then it's no until they come to an agreement one way or the other. Until your gf is 18, what they say goes, and if they say you cannot see her, talk to her, text her, talk to her on the phone, IM her, or contact her in any other way up to and including smoke signals and singing telegrams, then you can't, and you can be in serious legal trouble up to and including jail if you do so anyway. This includes responding if she contacts you.

You are legally an adult. She is legally a child. The four year rule you are so hopeful of does not give you permission to have sex with a 15 year old - it only reduces the number of things you can be charged with if you do. Mom cannot make the illegal legal, but dad can make the legal illegal.

why are the parents NOW jumping at you? well, why is dad jumping at you? when will she be 16? is she pregnant? b/c if they knew all along you were having sex, i'm lost as to why he'd be so upset all of a sudden...

Dad is well within his rights to warn you off his daughter, He can get a restraining order and you CAN go to jail if you say so much as hello to her after that. Even if she says hello first.

Told by whom? If they're not a lawyer, why are you listening to them? Because you like what they're saying?

And, just for the record, permission to DATE is NOT permission to have SEX.

Thank God you dont live in Utah, you would be screwed. If convicted which you probably would be you would have to register as a sex offender for the remander of your life. I would respect the parents wishes and stay away. The Parents could make you very mesirable.
