I was working on a sonar job last summer and was exposed to a toxin called Tributyltin, it is used as a paint like substance to keep marine life from the sonar. A few people got sick and went to the ER with chest pains, coughing and shortness of breath some released some not. A few weeks later I became ill with shortness of breath, chest pains, headaches, fatigue and couldn't sleep. I went to ER because I thought maybe heart attack but everything was fine with my heart. The ER doctor asked if I worked in the shipyard which he had no way of knowing that I did. The chest x-rays showed clouds and scarring on my lungs. I made a appointment with polmunary doctor. My symptoms kept getting worse and worse. My wife filed for SSD for me in Oct 2005 and received approval in April 2006. I had pulmonary fibrosis and stage 4 sarcoidosis this after a open lung biopsy. My health was not good I of course couldn't work in the shipyard with the dust, smoke, toxins, etc. I became depressed, had anxiety attacks, the breathing problems, vision problems, sleeping problems. I am on 200mg of zoloft perscribed by my psy dr, 750mg of vicodin, 80mg of prednisone, am starting to get winged off of it now. Can't do anything physical at all not even take a shower without getting out of breath. X-rays from a few years back showed fibrosis on my lungs but I felt fine worked 7 day's a week, worked out of town, 10 hours a day. After being approved for disability I found out that one of the other workers had gotten an attorney. This attorney found out about the toxic substance and letters that the employees never knew about. Osha became involved also. The president of our company admitted in a written letter of the dangers of being on this job. Do you think that I should file a WC Claim thru this attorney. The other worker settled for 20,000 dollars but he's not on ssd either. Also do you think this is a winable case.
