My 16 year old son had a 17-year old friend at the house while we were at work, and without our permission. During his visit to our house he got a BB gun off the top of our refrigerator, our son told him to put it back.

He took the BB gun out into the yard and was shooting various objects around the yard. My son told him several times that he should put it up.

My son was taking the BB gun into the house when the other boy pulled on my son's shoulder, as he turned the BB gun discharged striking the other boy in the corner of the eye.

This boy has incurred approximately $40,000 in medical expenses, $15,000 which his parents have had to pay out of their pocket.

His parents are now trying to obtain the name of our insurance company, apparently to try and file a claim aganist our homeowners insurance.

Should I give them the name? Should I try to fight this or let the insurance companies fight it out? What should I watch for? If my insurance company settles and decides to pay, could there be future problems?

My response:

If you don't give them the insurance information to make their claim, they'll just sue you anyway. So, you may as well give them the information and let the insurance companies investigate the facts.

Eventually, this type of claim will make it into litigation, and then when your son and the boy are placed under oath, that's when you'll find the truth of what really happened.
