What is the name of your state?PA My question is basically- do you have to actually leave the store with the stolen item to be charged with shoplifting? If you put the item down before walking out the door and then are arrested because a store clerk was sure you wanted to take it, what can be argued in your defense? My friend had a radio in his hand and when the beeper went off by the door he put it down and left. As he left he was stopped and arrested for shoplifting even though the radio never left the store, he put it down before exiting. How can he defend himself in court. He cannot afford a lawyer.Thanks

No. If the intent is clear, you can still be charged.

He can't. His clear intent was to steal the item and the only thing that stopped him from doing so was the MERCHANTS security systerm. Your 'friend' is also not only getting convicted, but he will also get a very nice demand letter from the merchant to recover the fees the retailer spent on security, etc.

So the only reason he didn't steal it is because the security beeper went off. BUSTED!

Your "friend" is going to have a hard time claiming he did not intend to steal the radio. He was past the last point of sale, after all.
