My son was involved in an incident in which he was being followed by the girlfriend of a friend he was with. The third time he pulled over to tell her to stop, he reached for her keys so he could toss them under her car in order to slow her down. She tried to stop him and somehow her ignition was damaged. She called the police and although it was a "he said, she said" situation, the officer told my son he had to pay for the damages or be arrested for auto-stripping (a felony). Of course he took the path of least resistance! Now she wants my son to pay for the towing. The officer told her that it was a civil matter and she would have to take him to small claims court. Should my son file a complaint for malicious prosecution? Harassment for both during and after the incident (we all have LOTS of phone records)? Can he file a complaint for aggressive and careless driving & Wanton Endangerment? Or a civil suit for abuse of process, since she lied about my son damaging her vehicle (if he had gotten to the keys you can be assured that they WOULD have been under the car). What about punitive damages? She has a history of finger-pointing and I believe she is on meds for bipolar disorder. I have always heard that she was a little "psycho."
