What is the name of your state?VA

Ex & I went to court on 09-15-05 and judge ordered cs, custody & visitation schedule for ex.

Ex is appealing the decision, we go to court on 01-11-06. He has hired a different attorney for the appeal.

Ex was granted EOW, and overnight on Wed. w/ the kids. Pick up time on Frid. to be at 6 p.m. bringing the kids home on Sunday at 7 p.m.

Last night when he came to get the kids for his weekend, he handed me a letter stating that he would now like to get the kids at 5 p.m on Fridays and keep them until Monday morning.

I do want to him to see the children, but I feel that he is only doing this to somehow use against me in court in January!

I believe that we would both be better off if we followed the CO until the appeal.

Advise, opinions needed!

Follow the order.

I would like to add that if you don't have a problem with the slight alteration that your ex is proposing (which I wouldn't see as problematic and not unusual), you should see about amending this for a Judge or Magistrate to sign without going to court (and since it's 2 months away!!) Either one of your attorneys should be able to assist you with this.

This poster does have a point, if those small changes are what your ex is appealing then it would be much cheaper and easier if you agree to them to just amend the order and have the judge sign it rather than having to pay your lawyer all of the money it will cost to go back to court and have the judge decide either way. But regardless to keep things as peaceful as possible stick to the court order until something with a judge's signature says otherwise.

No...he's not just appealing these small changes! He's appealing the whole decision; as he wants custody of the children! Not because he wants to deal with the kids but because his CS is high and he can't keep up with his lifestyle! I guess now would be a good idea to get rid of the 2 brand new $40K vehicles he bought while he wasn't paying any CS!

I wish it were as simple as a few little changes, but I believe that's he will end up using all of this against me somehow...I guess that is his next tactic!

Thanx...I think it would be best for us, until the appeal to keep to the visitation schedule that MY EX asked for and the judge granted!

Fairy4 ~ Do stick to the court order that the Judge signed. When you do go back into court the Judge will want to hear that you stuck with HIS decision (or another judges) over going OUTSIDE of the order and making things up. They like for you to follow what the piece of paper in front of them says you are to do.

That's exactly how I feel. Why didn't we just work everything out between the two of us before court then? That's why I feel he's trying to "get an angle" by trying to over ride what was just ordered 2 months ago.

Thanx for your opinion. I was leaning towards sticking to the court order, but I didn't want to seem unapproachable!

Hand him a letter back stating that you feel it's best to follow the court order exactly until the judge orders otherwise~ to protect you both.
