I was recently involved in a criminal investigation on behalf of my 8 year old daughter. She was molested by her 19 year old cousin. He has finally been convicted of a class X felony and sentenced to 6 years in prison. During the investigation I filed a police report. On this report I made the statement that "while he was growing up, his mother was employed as a stripper for "a certain company". She has now threatened to file a Libel suit for this comment.
First, the statement was on a police report. The report is not part of the publicly available court record of the trial. Copies are held by the local police department, Department of Children and Family Services, State's Attorney and the Public Defender. I believe all of these are "closed" files, especially since my daughter is a minor. I do not believe this is a "public" printing of the statement.
Second, I do believe the statement to be fact. My wife, her brother, and another sister have all witnessed her work. She would go to a bar and model lingerie. She would usually end up topless and collect tips from men. Instead of dancing on a table, she would mingle and flirt.
Third, I did not intend her any harm. I merely included the background information which DCFS and the police requested. I believe most people who know her, also know what her past line of work is.
Fourth, She claims this could affect her current job in the medical field. I don't see how, but I am not in the medical field.
I hope this is enogh information. So should I be overly concerned with this? Do you think she has a possible case against me?
