What is the name of your state? What is the name of your state? What is the name of your state? Indiana
We live in Illinois but alleged incident happened in Indiana.
It's a long story so I'll tell it then ask my questions ok?

I was not present but going on what 4 adults have told me.
My fiancée and 14 yo son went to my sisters for Thanksgiving dinner. Also invited was my mother and my brother-in-law's son and wife and their child. The son invited the sister and her kids. Children came in the house out of control from the start. Make a long story short, my 14 yo son was trying to keep the 3yo boy, 6yo boy, and 4yo girl entertained. The 6yo was caught "humping" the carpet by b-i-L son and told to stop. Sister (mom) was told and she said don't stop him, she allows this because it would ruin his sex life if you did is what she stated. Argument came up how he should be stopped. This then turned into Sister(mom) start talking of her sex life. How she is getting a divorce and she has got none in over a year. not to long after this, she finally decided to look for her kids. She did not see the 4yo girl. She and my sister went down the hall toward the bedrooms looking for her. The hallway is about 2 feet long. They heard the bathroom door open and there stood my son. The girl was not seen yet. All of a sudden the mom started screaming "Did you have her in there with you?" to which my son said no, he doesn't know where she is. The mother was out of control, continued to scream and yell I know she was in there with you. Then she accused him. What did you do to her? To which he replied nothing. He was quite confused as to what was going on. The girl was then seen in an adjacent bedroom where she was found earlier jumping on the bed. She was asked if she was in the bathroom with him and she said no.The mom still screaming asked what did he do to you. She said "nothing".The mom was told calm down that lets figure out all this but she would have nothing to do with that. She literally drug the kid out the door. When they left they immediately called the police and took the girl to the hospital. They were calling my sister and telling her what the doctors was saying. The doctor said that the girl was not violated or seem to be touched in any way. The girl said that my son was touching her and that is what the police went on. After about 2 or 3 hours waiting on the police, my boyfriend decided to bring my son home.Only the mother, her brother and wife, and the girl was talked to by the police. I got home from work and got a call from the police about 1am. They said to come in on Monday to talk about this and to get my sons statement. I went in on Monday at first he was saying he had a lot of evidence to arrest my son but he wouldn't. (probably scare tactic.)After he was told how the mother was acting and talking and after talking to my son, he said that he didn't believe he did it to go home and forget about this. Well obviously I cant.Remember there is more but this is just the facts.
Now questions:
First, weren't they supposed to come then and talk to my son?
and, will they notify me if there will be no charges or the disposition of this? If so what is the average wait time? Should I retain an attorney?(I cant afford to just retain unless I have to.) Also, I have 4 adults in this that state this did not happen or could it have. The mom for some reason just snapped.
More info: The son and daughter have been estranged from my brother in law for a long time. Their grandfather just died and left an inheritance. They are very greedy people. Another question: She knew after the doctors examined the girl nothing happened but she continued to want to have my son arrested. Is there someway I could sue her on my sons behalf for say intentional infliction on emotional distress? He got so sick after this. He has been down for almost a week now. Would I need an attorney for that or would that be small claims court. I just want her to pay for the problems she caused because SHE had sex on the brain all night. There was no reason to jump to this idea. NONE!
My son has never been in trouble. He wont even fight(defend himself) in school because its against the rules. Counselor, teachers, vice principle have told me he is one of the most kindest honest children they have seen in a long time so I not just being a mom to say that. ;) I just don't want this woman who tried to ruin his life walk away scott free. I'm just mad, scared right now and don't know what to expect. Please, any info would help. I am totally naive to all this, with the exception to traffic.

I would at least go for a consult with a criminal law attorney who has experience with false abuse allegations. Call your State Bar Association for a referral.
You can probably count on a visit from CPS (or whatever they are called in your area). Please read up on your rights:

Good Luck!
