I was told by my homeowners insurance company that a burst pipe was covered in my policy. I clearly stated we had found a leak and that mold was starting to grow in our basement. We found the source of the leak as we were told, which was a burst pipe and now they are denying our claim because of the mold. The leak is underneath a bathtub in our bathroom that had evidently been slowly leaking through a support wall and into a room adjacent to the support wall. By the time it showed itself to us mold had started to grow. We were never told in the initial conversation that mold was not covered. We were told that a burst pipe was covered and our plummer confirmed that. Burst pipes don't always blow they also leak. I have contacted the BBB and the NC dept of insurance who is waiting for the denial letter to help me further but the situation in the basement is getting worse and I need to know if I need to seek legal counsel. Time is of the essence. Can ANYONE help me.

If you're asking if you should get a lawyer because you were verbally told that mold was covered, then, no. Your policy, ie, the contract, is what is "law". Your contract likely specifically excludes mold, as most homeowners insurance policies do.
