Should I go to work before seeing the specialist???

Last week I tore both ligaments in my right thumb while at work. It has been 9 days & I am in a lot of pain. I've been to 2 doctors & will be referred to a specialist. My question is this....I am still going to work but my employer has not given me an alternate job to do (I have asked). I work as a bank teller & I am right handed. Sholud I go back to work at all until I've seen the specialist?????????

Have you been to the w/c doc? Has your W/C case been started? What does the doctor say, what are your restrictions? Have you asked for ADA accommodations? Are you seeing a hand specialist? When?

What are ADA accomadations? My employer has not helped me AT ALL with this. The first 2 Dr.s the bank ok'd didn't even accept w/c!! First 2 Dr.s said I may need surgery but never told me to stay home form work. Bank said next Dr. MUST accept w/c & finally gave me list to choose from. Bank paid for first 2 Dr. visits & prescription.

Should I go to work

Obviously you are already going to work even with your injury. Surf the web for Texas' workers' compensation commission. Read up on it. Ask your employer if they filed the workers' comp claim with their insurance company and ask them who their workers' comp insurance company is. You could call them to find out what your benefits are vis-a-vis pay while you're out of work.

Then pick one of those doctors or any doctor YOU want -- hand specialist -- and make an appointment. Schedule the surgery and return the paperwork to your employer.

Forget the ADA - Americans With Disabilities Act -- because the loss of use for one hand would not qualify as the loss of a "major life function" and, therefore, you would not be covered under the ADA. However, you are covered under workers' comp.

If your employer gives you any "grief," then find a workers' comp. lawyer. He/she won't cost you anything. Workers' comp pays for it.

Bottom line is that you have to listen to the doctor. The doctor/specialist will say what you can and CAN NOT do. He has to put this in writing before you return to work. They can either send you home and you collect a % of pay after so many days or provide you a “light duty job” Usually you only have ONE main doctor choice if you are unhappy with the one that they gave you. This is all IMHO.
