Hi. My husband has recently left the premises. It's not the first time, but this is the longest. I know he's not coming back as long as I'm living here. If I leave our house and rent somewhere close to my work, am I going to lose whatever interest I have put into that house? I want out, but I want my fair share as well. I think that this would be the key move to let him know I am not kidding around. Besides, I need a new start. I don't want to hurt him, I just want my life back. Thanks

Do you have children? Whose name is the house in? Was it bought before or after the marriage? Was marital income used to pay for the house?
You do not forfeit your property rights because you move out HOWEVER if you are on the mortgage you are still responsible to pay it.

A foreclosure IF you are coborrower would be a VERY bad thing for your credit. You are far better off staying, even if it means getting a roomate for a while to help cover expenses until you and he can agree on a sale.
