I am fairly sure that my deposit will not be returned for my last apartment and am wondering if I should sue. I lived in an apartment complex for 3 months, while my wife worked as a caretaker. She was wrongly terminated, and we were given 24 hours to leave the premises. During this time, we worked out a deal with the owner of the apartment complex to pay and stay for the rest of the month. We moved out and left the apartment immaculate.
However there have been issues which lead me to believe they will not be returning our deposit. The first was on the morning my wife was fired. A maintanace guy came into our apartment at 8:00 am while we were asleep. We woke up to him poking around, saying there was a leak above us, and that he was checking for damages. Our apartment manager always sends the maintainance guy in when she feels like harrassing residence, under the guiess of a "emergency check". I woke up and saw him, then made him leave.
Five minutes later we got a knock on our door. The apartment manager gave us a letter saying we were fired. She then took our caretaking keys and our mail key (by accident). We never asked for the mail key back because our mailbox didn't lock anyway.
Once that day, and once the next day we were given 5 minutes notice that they were showing our apartment and told that we must comply. I consider this to be in breech of their required 24 hours notice as well.
As we were moving out, we were harrassed 3-4 times, and told that we could not prop open a controlled entry door while moving our furniture. Eventually, we called the cops and they told management to back off.
I am wondering how much it will cost to recover my deposit, assuming they don't send it within the next 17 days (Lease ended 4 days ago). Thanks for the help!!
