I got into a car accident (rear ended)...can i sue the other driver? no registration; no driver's license; and probably no legal papers to stay here in the US ( Mexican driver )

How do you know he or she was illegal? Because they were hispanic? Plenty of people in California (and the rest of the US) with illegal cars and no license, and they're all good 'ol Americans, white, black and many other ethnicities.
