What is the name of your state? What is the name of your state?California

Lana,

I'm going to be filing my AOS package in 2 weeks. I am now trying to get everything organized, get my medical examination & pictures done etc. My story is I'm a Canadian Citizen married to a US Citizen, I have been here for about a year and a half because I've overstayed when I came over the border as a visitor.

What I'm wondering is I want to change my maiden name to my husbands last name but I can't change it legally as I need to do it in person in Canada. You've told me that even though that is true, I can use my new last name on my immigration forms as they will know because of my marriage certificate.

But I will also be applying for EAD, so because I am doing this, will it be better for me to just use my maiden name because if when I do start working, I will have no ID's with my new married name. Won't my married name, the name I was planning to file my AOS with, will it show up on my EAD? Will my maiden name be on it too?? I was wondering because it crossed my mind that I will probably have to prove who I am. So in reality, should I just keep using my maiden name? Thanks as always for your help!

Whatever you do, you should be consistent on all the applications so that the same last name is reflected on all your applications. You can do the new last name on all documents and after you get the social security number with the new name, you can do the name changes for your passport.

Please let me know if you have any additional questions or if I may be of further assistance to you in this matter.
