Should we sue a really old man ?

My husband and I moved from FL to a remote region in the NC mountains 5 years ago. Our new neighbor is an 84 yr old man who has a 150 yr old farmhouse next door who uses it 1-2 weeks out of the year. When we first moved here, our neighbor was so happy to have a young man next door he asked my husband if he could maintain his property for him and what he would charge ( Grass cutting, tree trimming, and the roads). My husband told him that in lieu of money, he would accept a couple of acres of land adjacent to our property instead. Our neighbor agreed this was a very good deal for him , being as the acreage was too steep to be useable and it is also where he electric lines run to our property. After 5 years of taking care of ALL the maintenance on his land, our neighbor started calling from FL all the time to insist more work to be done such as plumbing and electrical repairs, painting the whole house, fixing his truck and tractor, and his demands were now not simple maintenance. My husband got tired of being taken advantage of. We have noticed changes in him as he has grown senile, and there were other things he promised has totally forgotten about. My husband told him that he would no longer help him. Of course, then he was really mad, and he refused that he had ever made any agreement to give any land or any compensation what so ever in exchange for my husbands 5 years of labor. I scorned my husband for not having it in writing and now legally, there is nothing we can do. Now the man has solicited the free services of a 90 yr old mountain man to do his chores. This man is very uneducated, and driven by hopes that our neighbor will give him land. Last week, the old kerosene oil tank ( about 40 years old ) sprung a leak and 200-300 gallons of kerosene went all over his yard. The old mountain man called out neighbor in FL to tell him he thought my husband sabotaged the tank and that there were 4 wheeler tracks leading to the house. My husband is a general contractor and works 14 hours a day. When he comes home, he literally passes out. He did not , and would not ever do such a thing, nor would I and I don’t know how to prove it. This old has made serious slander at my husband. This 150 year old farm house is a serious state of disrepair as nothing has been upgraded, painted or maintained since the 1940’s. ( My husband was to maintain the grass and the roads ~ not the house !) I now fear that if anything goes wrong over there, this old man will accuse my husband of foul play. How do you deal with 2 senile old men like this ?

What exactly are you going to sue him for?

Being crazy? Being old? I am not an attorney, but as far as I can tell the biggest problem here is your husband not getting this "agreement" in writing. That man can bitch and moan all he wants but unless he has proof that your husband has done something wrong, what can he do? Contact the local authorities so there is a record of his accusations, and leave it at that. And next time you agree to do work in exchange for LAND, for God's sake, get it in writing and NOTARIZED!
