I have a trailer and the people are still there, they had given me 30 day notice they are moving as they did not want to renew the lease .Now do I have the right to show the trailer to people while they still live there?
they say no.
thanks any help would be appreciated

YES you have a right to show your property to prosepective tenants.

You should give the tenants 24 hours before you show it or have an open house for a couple of hours on saturday and sunday....

Here is the tricky part.....You are entitled by law not to lose one days rent.

So if you wait till they move out, the right tenant might not be able to sign a lease for a month.

So you have some options.......

Is the tenant breaking a lease? then the tenant is responsible for all rent lost, so let them decide if they want to pay you next months rent, and you only show it after they vacate.

If not, the lease is expired in 30 days....you could give the tenant ALL of their security back if you can show the house.

It is a business you have a right to re rent but YOU also take a chance you wont find a great tenant to replace them the day after their lease expires.

Remember the tenant feels that you are really imposing on them by you doing this, And if the tenant is happy, they will convey that to the prospective tenants, so paying them back ALL of thier deposit might be a very wise business thing to do.

You may well have the right under your state law; however, you probably don't want to.

If there is any contention between you and tenants, don't subject any prospective new tenant to their vitrol.....don't waste advertising money - wait until current tenants leave and then put ad in paper and start showing when the property lookgs good - is clean and ready to move into.

ok i live in catskill, ny,
the tenants were on a year lease it was up in december they were then on month to month, but they had moved in there 32 yr old son so we gave them a new lease with raise in rent as they new we would do this if any others moved in.so they decided they would not sign the lease because they are on section 8 and they did not want section 8 to know about the son moving in.
i was told I can show the trailer while they are in there by section 8,
but they are not letting me do this

That is different you are evicting them.......

They have no lease.....

Just give them a letter stating that you have a legal right to show the property with advance notice, if they refuse then they would be liable for every day in February that you lost rent and it will be deucted from their deposit.

then let them decide.

I did not know that this would be considered I was evicting them as they are the ones that said they were moving.

I will do just that with letter.
