What is the name of your state? Nj I would like to know. If I refuse to release my child when she is sick(fever, croup , bronchitis, etc, ) have called the father before hand and asked to let her sstay and sleep and recover. He refuses ,"It is his time" doesn't give medication when it is supplied to him. I realize I would be in contempt of the " vistation" but I also know he doesn't put her well being first nor allows her rest and recovery as a sick person should be getting. If the police are called at that moment and asked to come to my house would they remove her, knowing perfectly well why I refused? I have faced this already ( no police yet) but he made me wake her up rather then letting her sleep the night and pick her up in the am if she was better. Refused to give her ,her medicine and returned he more run down and with a fever again. His comment she has ten days to recoup> Will the police remove her at that moment or just write a report, so he can use it later to show contempt on my part.

I don't know NJ, but in most states cops don't get involved in domestic cases like this. If they did though, and dad had his paers in hand, you would have to hand over the child.

Really if he wants to be a dink about it it is his time, and whether he cares for her properly or not is not your call, just as it is not his when you have her. Kids can have relapses, it happens. If it went to court it would just be a he said-she said battle.

he would need to build a pattern of you refusing visits before he could take you to court. unless this kid is sick ALL the time that won't likely happen. And in that case you have bigger problems (why is the child always sick?) Do you want to give him the first check against you in his record of refusals over this? Try to think of the bigger picture.
