I boarded my pregnant Jack Russell at a boarding facility for 10 days. Upon picking her up i noticed a horrible cough. Took her to an emergency Vet and she was diagnosed as having kennel cough +/- phnemonia. She needed to be put on oxegen and antibiotics. She needed to see a vet specialist the next day. They were in fear of her losing pups. I am out a total of 900.00 in vet bills as well as the boarding fee of 112.00. is this worth pursuing in small claims court. what are the odds of collecting? Im not sure if it is state law or not but they did not require medical papers when i filled out the paperwork-they "let me slide" because i could not produce them. Please help!!

To prevail in a lawsuit you must prove; 1) defendant acted negligently, and 2) as a result of that negligence you incurred damages.

Just because your four legged buddy caught a respiratory infection does not prove that said damages resulted from any negligence on the part of the kennel.

Like any contagious infection such as a cold, kennel cough spreads easily where animals are confined together. That is just the way it is.
