What is the name of your state? ohio i work at a physically demanding job. employees go off hurt all the time. in 4 and 1/2 years i have had 3 right shoulder surgeries. 2 by their dr. and the last by my dr. and now its fixed. i was on sick leave for 6 months each time. everytime they have called shortly after surgery during recovery to tell me come back or your fired. now , cancer runs in the family and i am having some tests run because of extreme migranes. they want to make sure its not cancer and i have followed the guidelines set fourth and they are threatening again. they are using the shoulder surgerys the recent death of my mother and this as leverage. these are medical problems, ifollowed their rules. i had surgery. can they fire someone with varifible excuses?

Of course they can fire you...they are running a business which means they need employees to run the business. You have not indicated the company size (number of employees at the particular location you work at) or the amount of time missed. So no one can tell you if the FMLA applies.
