What is the name of your state? California

My husbands ex-girlfriend/mother of his 1 year old girl has basicly been having issues with housing. She has been kicked out of a house that she lived in with her aunt and since then has been either living motel to motel or, with friends. The environment has not been good for the child. I suggested we take her for a week so we did and basicly, when my husband went to take his daughter to the mother the place she was "staying at" was just horrible so he suggested to the mother that he keep his daughter another night.... to make a long story short we have the child, the mothers friend typed out a letter stating that "Father has temporay 80% custody until July 11th 05", my hubby signed this letter since if he didn't he couldn't get his daughter away from those horrible conditions. If we were to go down to the courts and file for full physical custody do you think that were gonna have problems as far as that letter goes?
