Simple assault on an officer

A gentleman I know was recently assaulted by a couple of gentlemen for his brand new iPhone 10. He put up a fight (both of his hands were swollen) but lost and was least unconscious and naturally lacking his phone. Officers were called to the scene and tried to wake him up. He apparently woke up and started swinging at the officers (presumably believing he was still being attacked) but made zero contact (hence the simple assault charge). What's the likelihood that these charges can get dropped versus sticking?

The gentleman should ask this question to his attorney.

It appears the gentleman needs an attorney.

It occurred in Virginia. His family is finding him an attorney. Right now he's being held without bond
He needs to speak to his attorney, and only his attorney about this matter. You should not post his legal matters on the internet.

No, it's just the arresting officers report. He was unconscious, beaten, dragged and drunk when they found him
That's an interesting new wrinkle that changes the entire tone of the event. Please make sure he speaks only to his attorney...not even his parents.
