My husband works for a construction management company (architectural dept.). He started a Simple IRA with them in Jan. 2004. They deduct part of his salary each week for this but they only send it in to the securities co. quarterly. Also, they have only sent in a matching amount once (Jan. 2006) since starting this IRA. We believe his salary deferrals are supposed to be sent in at least monthly and the matching each year. Also, there is one month's deferral from 2004 which is not accounted for. The office manager has the information about regulations on this Simple IRA but insists she's doing it correctly - several employees have approached her about it - but no change has been made.
My husband would quit this job in a heartbeat if he knew there was a way to start an individual or class action suit regarding this issue. Someone advised him to contact the Labor Commission, but if he's known to be the whistleblower it could mean trouble at work. Thanks for any advice about how to proceed. We have all documentation to show deductions, contributions, etc.
