What is the name of your state (only U.S. law)? Doesnt matter what state I am in.....The father of my 3 yr old daughter has once had a domestic violence restraining order on him. he is truly very intimidating and threatning. I have talked to my company and they have agreed to allow me a transfer out of state i have been advised by my local Domestic abuse shelter to seek out a restraining order once i get to the other state......My question is What state(s) is it easiest to get a domestic violence restraining order when there has been no police contact with me and the father and I dont have any evidence of the abuse other than he once had a restraining order for threats agaisnt him in 1998 and then violence in 2001 two different girlfriends. is that gonna be enough for me to get one now as well? Thank you

A) we don't help with forum shopping;
B) it most likely would not be enough;
C) are there any court orders regarding the child?
D) You had the child in 2008 AFTER he had all this DV orders -- that is NOT going to get you anywhere.

what states are historically the easiest to get an order of protection i have family in N dakota wisconsin minnesota and ohio. does that help....im not forum shopping im leaving him soon but need to be protected.....maybe i wont need to get one im sure he has another girl lined up, how long after i leave do i need to get one, cause when i do get one he will knw where im close by right?

I find it quite amazing that your first post in this forum was for the express purpose of being unkind to another sufferer.

im leaving no matter what. our custody order says "parents are awarded 50/50 custody n placement" and he signed the paternity papers but from what ive read on here because there are no times indicated in the order and we are not married i can just take the child anyways cause im the mom. we were never married either, well i was, but havent told him and i have since sewed that up over the phone, cause if he found out i would get threatned Im sure......what do you mean by your response in(D) whats not going to get me anywhere.....I am so scared and need help to protect myself and my daughter from his threatning ways....please help

WRONG. You have a custody order. You don't win because you are the mom. He has 50/50 placement. If you leave without doing a proper notice of relocation and filing to change said custody order, YOU will LOSE custody and may only receive supervised visits. When did said order happen?

So you lied to him? How did you sew that up over the phone? Hence you are a liar. Hence you have lost credibility.

Because after all that happened and you could have/should have known about it, you still VOLUNTARILY spread your legs for him, allowed his penis into your vagina and conceived a child with him, said child that you carried to term and established his paternity and there is a court order concerning said child. That all happened AFTER 1998 and 2001. Hence those things matter not.
I am so scared and need help to protect myself and my daughter from his threatning ways....please help
What threatening ways? And it is NOT just your daughter. She is his daughter as well and HE has a right to custody.

More importantly, the stated purpose was asking for assistance in separating an innocent child from his/her father.
I was insensitive in my first post because I feel as if that person was 'crying wolf' as she made no mention about it (abuse or threats) in her first post, and god knows many woman do this....and it hurts the woman who truly are in danger.
I apologize I shouldnt have jumped the gun on her. (first post by me)

This is EXACTLY forum shopping. You're looking for the easiest place to getwhat you want.

Get one locally. In your own county.....you know, the place with jurisdiction
