What is the name of your state?nevada.I have a sheriff's card, which i need to have to work at a casino in Nevada. I have certain conditions on that sheriffs card which are as follows; refain from the use of illegal substances and remain free from criminal prosecution. This is dated 2/16/05. however a few months before these conditions were set; on 11/24/04 I had to do a urine test for drug inforcement officers which they said the d.a. may or may not pursue. That test came back possitive that same day,(11/24/05)BUT i am just now being charged with it;(4/7/05) so my question is; ''can they take my sheriffs card away even if this happened before the conditions were made?''

I think you may have a problem....

At the time the card was issued, you had not been prosecuted. So, at that time you were "free from criminal prosecution." However, here's where is the key word "remain" comes into play. After issuance of the card, you failed to "remain free from criminal prosecution" as I read what you have written.

Think about it as if it were a different crime, such as murder. If you murdered someone before they gave you the card and charged you after the card was issued, would you expect the sherrif's card to still be valid?

What surprises me is that it refers to "prosecution" which means that you are being charged with something. It would seem that the finding of the court with regard to guilt or innocence would be what the sherrif's department should really base the card validity on. Basically, should they be able to take your card even though you may be ultimately found to be innocent in a court of law?

PS - If you have taken illegal substances, that's a bad thing. The fact that you are a single mom makes it worse. However, if the test results are faulty or due to perscribed substances, I hope you fight it and win. Good luck!
